Privacy and Cookie Notice for Dailymotion Status Page Users

Status Page is an information service accessible to the Dailymotion users (registered Users and prospects) displaying both current and historical status and uptime information of the Dailymotion Service (“Status Page”).
The Status Page is hosted and operated using the technology of Dailymotion’s service provider – Atlassian and, in particular that of Atlassian Inc. subsidiary – Dogwood Labs, Inc., d/b/a StatusPage.io (“Atlassian”).
This “Status Page Privacy Notice” is provided by Dailymotion SA (“Dailymotion”) in conformity with Art. 13 and 14 of the General Data Protection Regulation (GDPR). Additionally, it provides information on trackers used on the Status Page.
The Status Page Privacy Notice applies to processing of personal data of users of the Status Page that is subject to the GDPR, and when and to the extent a privacy notice is otherwise necessary under other applicable privacy laws, to the processing of personal information that is subject to these applicable privacy laws.

| Processing purposes, legal basis, and legitimate interest disclosure | Status Page provides information about operational state of various Dailymotion Service technical components and allows subscription to the Dailymotion Service status update messages (“Info Massages”). Your personal data is processed for the purpose of providing you access to the Status Page, ensuring its secure and proper functioning and allowing you to subscribe to the Info Messages. When you use the Status Page, the processing of your personal data is based either on contract, i.e. to provide you with secure access to the Status Page and its functionalities, or on compelling legitimate interest, i.e. to ensure the overall security of the Status Page and analyze its use aiming at maintaining the Status Page fitness for its intended purpose, i.e. provision of pertinent and up-to-date information on the operational status of the Dailymotion Service. When you subscribe to Info Messages your personal data is processed based on your consent as such subscription is left at your sole discretion. When you receive Info Messages, the processing of your personal data is based on contract, i.e. it is necessary to deliver the Dailymotion Service updates you requested from us. When we process your information in response to your request to exercise your privacy rights, we do so based on a legal obligation of a data controller to process data subjects’ requests. When we retain your information for the establishment, exercise or defense of legal claims, we do so in conformity with art. 17 of the GDPR and rely on compelling legitimate interest that you cannot oppose to. When our processing of your personal data relies on consent or legitimate interest you may withdraw your consent or oppose to such processing at any time by simply communicating your decision to us through the Contact Form. Note that you can unsubscribe from Info Messages at any time by clicking on the “unsubscribe” option within any received Info Message. You will no longer receive the Info Messages with the exception of Info Messages already in progress at the time of your subscription termination, which, for technical reasons, cannot be modified. |
| Data categories and data origin | To the extent the data processed by us is personal data, we process the following categories of personal data: – contact details, ex. email address to be used for the purpose of Info Messages; – analytic data regarding your use of the Status Page; – your privacy preferences. Note that the Status Page use is explicitly limited to the Dailymotion Service Users and prospects. Status Page is part of the Dailymotion Service, and, pursuant to the applicable Terms of Use, access to the Status Page by means of automated processes is prohibited. In order to protect the Status Page and ensure its continuous availability to legitimate users, Dailymotion uses third party proprietary technologies, namely Google reCAPTCHA. | Transfer to third countries | We use Atlassian for hosting Status Page, dispatch of the Info Messages, management of unsubscribe decisions, and related customer support. Any resulting transfer of your personal data to third countries is based on the European Commission Standard Contractual Clauses and Atlassian’s participation in the Data Privacy Framework. Your personal information may be shared, on a need-to-know basis, with non-European Dailymotion group companies. | Storage Duration | When your contact details are used for the Info Messages, they are retained for as long as you are subscribed thereto. Upon your un-subscription, they are deleted from our systems. Any analytic data is aggregated by us before being used for the general purpose of maintaining and improving the Status Page. When your personal information is processed for establishment, exercise or defense of legal claims, it is retained for a period of 6 (six) years following the end of its initial processing. When applicable, that period may be extended when required for the purpose of legal proceedings launched. |
| Rights of the data subjects | If Dailymotion has collected personal data from you, you have the following rights under Articles 15 to 22 GDPR if the legal conditions are met: right to information, correction, deletion, restriction of processing and data transferability. Furthermore, according to Art. 14 para. 2 lit. c in conjunction with Art. 21 GDPR, you have a right of objection to the processing based on Art. 6 para. 1 lit. f GDPR. When our processing is based on your consent or on legitimate interest, you may, at any time, withdraw your consent or oppose to our processing. Your withdrawal or opposition will not affect the lawfulness of processing taking place prior thereto. | Complaints to the supervisory authority | Under Article 77 GDPR, you have the right to file a complaint with the supervisory authority if you believe that our processing of your personal data is unlawful. | Obligation to provide personal data | There are no contractual or legal obligations to provide your personal data. However, when this data is necessary to provide you with the services requested (ex. to send you Info Messages) in the absence of such data we will be unable to do so. |
