Copyright Repeated Infringement Policy
This Copyright Repeated Infringement Policy is a part of Dailymotion’s repeated infringement policy, as available in Dailymotion’s Terms of Use. It specifically aims at tackling repeated copyright violations which may occur on the Dailymotion Service.
As a reminder, Dailymotion takes compliance with its Prohibited Content Policy and its general Terms of Use very seriously in order to ensure a safe and respectful viewing environment for its Visitors, Users and Partners.
As detailed in Section J of our Prohibited Content Policy, the distribution of any content reproducing all or part of a work protected by a copyright without the authorization of the author or the person who holds the rights for this exploitation is forbidden, unless it falls under one of the exceptions listed in such Section.
Please note that Dailymotion’s assessment and decision is made at our sole discretion in accordance with our Repeated infringement Policy. Throughout periodic reviews of Dailymotion Accounts likely to be in breach of such Policy, Dailymotion reserves the right to apply more or less severe sanctions, which can be permanent or temporary, and in some instances, have immediate effect.
We also inform notifiers that it is not possible to submit takedown requests for copyright infringement concerning an entire channel. The assessment of the seriousness or repeated nature of infringements on a channel is solely at the discretion of Dailymotion, which conducts periodic reviews and imposes appropriate sanctions in the event of a violation of our repeat infringer policy. Therefore, no takedown request for an entire channel due to copyright infringement will receive a specific response addressed to the notifier in this regard. However, if you believe that one or more pieces of content on a channel violate your copyright, you may submit a takedown request for the specific content in question, provided you comply with the notification requirements set out in our Prohibited Content Policy, using this form, which is the simplest and quickest method.
What happens if you receive a copyright strike?
In the event we receive a copyright content removal request about your video, which we deem to be a valid request, such copyright-infringing video will be deleted, and you will be notified about it by email.
If this is the first time you receive an email informing you about the removal of your video for copyright infringement based on a legitimate request, it will count as your first copyright strike.
A copyright strike lasts for 90 (ninety) days.
If you believe your video has been removed by mistake (e.g. you consider that you have a legitimate right to use the copyright-protected works in your video, per one of the applicable legal exceptions), you have a right to appeal such decision through the link that was provided to you in the email informing you of such decision.
If your appeal leads us to overrule our initial decision, your video will be reinstated, and the associated copyright strike will be removed. We may also remove a copyright strike if the claimant withdraws its notice.
It may happen to make mistakes. However, after too many copyright strikes over a period of 90 days, you will receive an email informing you that you are restricted from uploading any content on the Dailymotion platform for a period of 7 (seven) days.
In the event despite this suspension, you continue to get too many copyright strikes from one or several rightholders on a 90-day period, your Dailymotion account will be immediately and permanently deleted, along with all the videos you uploaded on such account.
If you are a member of the Partner Program, you might be granted a few days-window of limited access to your Dailymotion account before it is terminated so that you can archive your non-infringing video catalog.
Dailymotion’s decision to restrict or suspend your use of our Service, and for how long, takes into account a combination of factors, as required by article 23 of the Digital Services Act (DSA).
These factors notably correspond to the nature of the infringement, the gravity of its consequences, the volume of illegal content within the 90-day period, the proportion of infringing content in relation to the total number of content uploaded, as well as the intention of the uploader, where possible to identify.
They help determine the appropriate penalties and may lead to a gradation of sanctions, notably for members of the Dailymotion Partner Program.
