1. DESCRIPTION OF DAILYMOTION

What is Dailymotion?

  • Dailymotion is a platform where you can upload, watch, and share videos with others for free.
  • You can use it on its website, apps, or player on other sites. We call it the “Dailymotion Service.”

Who can use Dailymotion?

  • Everyone, but you can have a different status depending on how you use the Dailymotion Service.
  • When using Dailymotion without creating an account, you are a “Viewer”: You can watch and share videos but some features are unavailable.
    You are a “User” if you create an account. It allows you to upload videos and use more features, but you must be at least 13 years old to create an account. You also have to confirm your email to upload videos.
    Some Users can join the Partner Program to make money with their videos. They’re called “Partners” but they have to be at least 18 years old to become one, or they can be a company.
  • In any case, anyone using the Dailymotion Service has to accept and respect the rules of our Terms of Use.

Information about your Dailymotion account

  • You are responsible for your account:
    • Don’t provide false information.
    • Keep your username and password only to yourself.
    • Report any unauthorized use of your account.
  • Inactive accounts may be removed: if your account is inactive for too long, Dailymotion may delete it.
  • Advertising on your account:
    • Ads are part of Dailymotion and help keep it free. Using ad-blockers is not allowed. If detected, Dailymotion may block your access.
    • Ads can appear in the video player or on our website and be played with your videos from time to time.


2. ACCEPTING THE TERMS OF USE

Agreement to follow rules

By using Dailymotion, you agree to the Terms of Use, Prohibited Content Policy, and privacy and cookie policies.

If you don’t agree with these, you should stop using Dailymotion. Continuing to use Dailymotion means you agree to the rules.

Who are you agreeing with?

  • If you live in Europe (the European Economic Area more precisely), in the United Kingdom, or in Switzerland, the agreement is made with Dailymotion SA, a French company.
  • If you live anywhere else, the agreement is made with Dailymotion Inc, a USA company.

Changes to the rules

  • Dailymotion may change its rules from time to time. Big changes will be announced but we recommend you check the rules from time to time.
  • If you keep using Dailymotion after the change, you accept the new rules.


3. YOUR INTELLECTUAL PROPERTY RIGHTS

Giving Dailymotion permission to show your videos

By uploading your videos, you allow Dailymotion and its partners to use and share, such videos globally, unless restricted in your account settings.

Others can share your content

Your videos can be viewed and shared by others on Dailymotion and other sites using Dailymotion’s video player.

Your content belongs to you

Even though Dailymotion can show your content, it’s still yours. However, it may be copied or stolen by others since it’s online and available for everyone.


4. DAILYMOTION’S INTELLECTUAL PROPERTY RIGHTS

What you’re allowed to do

  • You’re allowed to use Dailymotion, but only if you follow the rules.
  • The permission is for you alone and can be taken away if you break the rules.

What you’re not allowed to do

  • Don’t download, copy, share, sell, or change anything on Dailymotion that belongs to Dailymotion.

What belongs to Dailymotion

  • Everything on Dailymotion—except for your videos or other’s videos – like text, images, brands and logos, software, and other content on Dailymotion belong to Dailymotion or its partners.
  • You can’t use them without permission.


5. WHAT DAILYMOTION IS NOT RESPONSIBLE FOR

Dailymotion doesn’t have to check all videos before they are uploaded, but will remove videos that break the rules as soon as informed about it.

Your responsibility for your safety

You are responsible for your account, content, and device safety.

Dailymotion’s service is “As Is”

  • Dailymotion can’t guarantee everything works perfectly all the time.
  • Dailymotion isn’t responsible for service issues, mistakes, or inappropriate content.
  • There can be problems Dailymotion cannot control: Dailymotion is not responsible for issues caused by things outside its control, like internet problems or natural disasters, for instance.
  • Limits to Dailymotion’s responsibility: Dailymotion is not responsible for problems like loss of data, reputation, or money unless required by law.


6. RULES FOR USING DAILYMOTION

  • You’re responsible for your actions: Follow the law, be respectful, and don’t upload harmful or illegal content. You can find a summary of our Prohibited Content Policy here.
  • Share only what you are allowed to on Dailymotion: If you share content that does not belong to you, make sure you have the right to share it.
  • Protect your content: Dailymotion is not a backup service. Save copies of your videos you don’t want to lose.
  • Don’t cheat or misuse the service: Don’t fake views or likes, abuse tools, break or copy our Service or promote illegal activities.
  • Don’t make money on Dailymotion without our permission: You can’t make money out of Dailymotion’s tools or content without our permission.
  • Use Dailymotion responsibly: Only use Dailymotion for personal use and streaming. Don’t use others’ videos without permission.
  • Don’t watch nor share illegal content uploaded by others, but rather report it to us.

7. HOW TO REPORT ILLEGAL CONTENT

8. DATA, ADVERTISEMENTS, AND PRIVACY

  • Dailymotion records:
    Dailymotion keeps records of emails, sign-ups, and videos. If there’s a difference with yours, Dailymotion’s records will be used.
  • Links to other websites:
    Dailymotion isn’t responsible for other sites you visit through links available on Dailymotion.
  • Advertisements:
    Ads on Dailymotion may be connected to your account or videos.
  • Data storage:
    Dailymotion stores your data globally, this means it can be stored outside of Europe. By using the service, you agree to this.
  • Personal information in videos:
    Get clear permission before sharing someone else’s personal information in videos (name, photo, address, etc.).
  • Privacy policy:
    You can view Dailymotion’s Privacy Policy on its website. It explains in details how Dailymotion can use your personal information.
  • Recommendations:

9. MISCELLANEOUS

  • These rules apply as long as you use Dailymotion.
  • Some rules still apply even after you stop using Dailymotion.
  • If a rule doesn’t apply because of a law, the rest of the rules still apply.
  • Breaking a rule once without Dailymotion noticing doesn’t mean you can break it again.
  • Disputes will follow French law (if in Europe) or New York law (elsewhere).
  • These Terms replace any earlier agreements you may have had with Dailymotion.
  • Dailymotion may send updates to you by email or posts on its website.
  • Not enforcing a rule right away doesn’t mean it’s ignored forever.
