This “Recruitment Privacy Notice” is provided by Dailymotion SA and Dailymotion Advertising SAS (hereinafter Dailymotion) in conformity with Art. 13 and 14 of the General Data Protection Regulation (GDPR).
The Recruitment Privacy Notice applies to processing of all job applications by Dailymotion that are subject to the GDPR whether received via the SmartRecruiters platform or otherwise, whether initiated by you, us or a third party and whether for a specific job opening or for general recruitment purposes.
Note that when you apply to a job opening with a non-European Dailymotion group entity (e.g. Dailymotion Inc. or Dailymotion Asia Pacific PTY Ltd), your application is processed pursuant to local applicable laws.

Processing purposes, legal basis, and legitimate interest disclosure | Your personal data is processed for the purpose of current and future recruitment including related statistics and analytics, to ensure security of the use of the Dailymotion space on the SmartRecruiters platform, and for the establishment, exercise or defense of related legal claims. When you apply for a position, either directly or through the intermediary of an employment agency, the processing of your personal data for current recruitment is based on your consent. When we receive your contact details from third parties, e.g. from a person suggesting your profile for a job opening, or from services whose features include the facilitation of recruitment (e.g. LinkedIn), the initial processing of your data (e.g. when we first contact you) is based on legitimate interest (i.e. legitimate interest of an employer to seek job candidates and legitimate interest of job candidates to be contacted by recruiters). After that, we will only consider your profile for a job opening if you consent to it. Consequently, further processing for current recruitment is based on your consent. When, upon termination of a current recruitment process, we retain your job profile for future recruitment, the processing of your data is based on legitimate interest (i.e. legitimate interest of an employer to maintain job candidates’ profiles for future job openings and legitimate interest of job candidates to be contacted by recruiters). When we process your information in response to your request to exercise your privacy rights, we do so based on a legal obligation of a data controller to process data subjects’ requests. When we retain your information for the establishment, exercise or defense of legal claims, we do so in conformity with art. 17 of the GDPR and rely on compelling legitimate interest that you cannot oppose to. When our processing of your personal data relies on consent or legitimate interest you may withdraw your consent or oppose to such processing at any time by simply communicating your decision to us (global-talent-acquisition@dailymotion.com or through the SmartRecruiters platform). Note that if your application is retained for a job opening, your personal data will be used for consequent purposes of hiring and employment relation management. |
Data categories and data origin | We process the following categories of data: any information that you provide to us either directly or through a third party, when you apply for a position with Dailymotion or otherwise contact us (e.g. resumes, cover letters, diplomas, references, salary expectations, etc.); contact details and other information that might be addressed to us by a third party (e.g. in case of so-called job-referral); contact details and profiles published by you on services that include recruitment features (e.g. your profile made available on LinkedIn); your privacy preferences; any information generated as a result of a recruitment process (e.g., dates of job interviews, questions in job interviews, etc.); on-line usage data collected by our service provider and operator of the SmartRecruiters platform (e.g., IP address, User ID, mobile device used, operating system, internet provider, date and time of logon and logoff); for further details please refer to SmartRecruiters Privacy Policy. Recipient | Your personal data may be disclosed to the following entities: – staff members at Dailymotion: your data is accessed by competent HR personnel and may be shared, on a need-to-know basis, with teams involved in the recruitment process; – your professional references: we may contact third parties you provide to check your job references, when so required under applicable laws, subject to your consent; – our service providers and their sub-processors: we use SmartRecruiters for hosting our recruitment data and related processing (e.g. messaging); we may also share your data with employment agencies or referring entities, in both cases on a need-to-know basis. When your application is analyzed by authorized Dailymotion staff members, it may be processed by our service providers (e.g. when your application is discussed internally through exchange of emails) the list of which is available here; – legal counsel: insofar as this is necessary for legal defense or enforcement of claims or verification of employment-related legal rules. Note that if your application is retained for a job opening, your personal data will be communicated, on a need-to-know basis, for further processing for the purpose of management of employment relationship, to competent Dailymotion staff and dedicated service providers (e.g. payroll managers), public authorities and third parties (e.g. labor doctors, professional training organizations, etc.) as necessary to accomplish employer’s legal obligations. |
Transfer to third countries | We use SmartRecruiters for hosting our recruitment data and related processing (e.g. messaging). When your personal data is processed by SmartRecruiters it is processed in the United States. This processing relies on SmartRecruiters participation in the Data Privacy Framework. For further details please refer to SmartRecruiters Privacy Policy. Depending on the job opening your profile is consulted for, your personal information may be shared, on a need-to-know basis, with non-European Dailymotion group companies. Any consequent transfer of your personal data outside of EEA, UK and Switzerland relies on Standard Contractual Clauses and Data Privacy Framework. |
Duration of storage | When your personal data is processed for a recruitment purpose, it is kept for the duration of the recruitment process, namely, until hiring or the end of a trial period of a selected candidate, if applicable (estimated at 11 months). Following that period, when your data is retained for future recruitment opportunities, it will be kept, subject to your opposition right, for a period of 2 years (renewable subject to your notification and in absence of your opposition thereto). If you contact us for a general recruitment purpose (as opposed to applying for a specific job opening) it will be kept, subject to your opposition right, for a period of 2 years (renewable subject to your notification and in absence of your opposition thereto). When we receive your contact details from third parties, e.g. from a person suggesting your profile for a job opening, or from services whose features include the facilitation of recruitment (e.g. LinkedIn), your personal data is retained for up to 30 days pending your consent for its further processing. In the absence of your consent, it is deleted. Please note that if we contact you directly through dedicated channels of services whose features include recruitment facilitation (e.g. LinkedIn), different retention periods may be imposed by these services. When your personal information is processed for establishment, exercise or defense of legal claims, it is retained for a period of 5 years following the end of its processing for the initial recruiting purpose. When applicable, that period may be extended when required for the purpose of legal proceedings launched. |
Rights of the data subjects | If Dailymotion has collected personal data from you, you have the following rights under Articles 15 to 22 GDPR if the legal conditions are met: right to information, correction, deletion, restriction of processing and data transferability. Furthermore, according to Art. 14 para. 2 lit. c in conjunction with Art. 21 GDPR, you have a right of objection to the processing based on Art. 6 para. 1 lit. f GDPR. When our processing is based on your consent or on legitimate interest, you may, at any time, withdraw your consent or oppose to our processing. Your withdrawal or opposition will not affect the lawfulness of processing taking place prior thereto. Complaints to the supervisory authority | Under Article 77 GDPR, you have the right to file a complaint with the supervisory authority if you believe that our processing of your personal data is unlawful. The comptent data protection authority in France is Commission nationale de l’informatique et des libertés (CNIL). |
Obligation to provide personal data | There are no contractual or legal obligations to provide your personal data. However, in the absence of some information needed to appreciate your application’s compatibility with the job opening (e.g. certificates confirming you having qualifications required for a posted job), your application may be rejected, or its review may be abandoned. Please note that for the candidates selected for a given job opening, provision of certain information may be mandatory for hiring purposes. That processing is not part of the recruitment process and is subject to separate rules applicable to the hiring process. |
Profiling | Any information that you provide or that is otherwise legally accessible to us may be used to contribute to the creation of your profile as a candidate for a job opening at Dailymotion. Note that any decision taken based on your profile is subject to human appreciation. |
