What is meant by ‘Personal Information’?
“Personal Information” is a term defined by state laws. Although the legal definitions vary from state to state, Personal Information – also called “PI” – refer to information about real persons and can be described as any information that identifies, relates to, describes or is capable of being associated with you, whether directly or indirectly. PI can be anything from your name or your email address to any unique identifier assigned to you by a website, your IP address, information on the Internet browser you use or your geolocation data. Information that relates to legal entities is not Personal Information.
What is meant by ‘Sale’ of Personal Information (“PI”)?
“Sale” or “Sell” are terms defined by state laws. Although the legal definitions vary from state to state, Sale occurs when PI is disclosed to a third party for monetary or other valuable consideration. It covers more situations than you would traditionally consider to be a “Sale.” A sale of your PI may occur when Dailymotion, as part of our business activities, discloses your PI to a third party that is not our service provider even if we receive no money for the PI itself. Ex., under the California privacy law what matters are that the PI is disclosed in exchange for some “valuable consideration” and that it is used by the receiving party for its own independent business purposes. A “Sale ” does not occur when the PI is disclosed to our service providers or when third parties use your PI only for purposes expressly authorized by the applicable state laws (ex. for security reasons).
What is meant by ‘Share’ of Personal Information?
Under the California privacy law a “Sharing” of your PI occurs when Dailymotion communicates, in whatever form, your PI to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration. In other words, we “Share” your PI when the ads you are shown on the Dailymotion Service are selected based on information about your navigation on different sites and services. We do not “Share” your PI when the ads you are shown are selected based only on your use of our Service. Consequently, you cannot opt out of such tailored advertisement. Share is often referred to as “Targeted Advertising” under other privacy state laws.
What is meant by processing of Personal Information for the purpose of ‘Targeted Advertising”?
Applicable USA state laws define “Targeted Advertising” as displaying to a consumer an advertisement selected based on personal information obtained from that consumer’s activities over time and across nonaffiliated websites or online applications to predict such consumer’s preferences or interests. “Targeted Advertising” corresponds to the term “Share” used by the CCPA. Display of ads tailored based on your activities within the Dailymotion Service (Dailymotion website and application and our Video Player embedded on 3rd parties’ sites or apps) is not Targeted Advertising since, in such case, the PI used is not obtained from your activities over time and across nonaffiliated websites or apps. Consequently, you cannot opt out of such personalized advertisements.
What kind of Personal Information might Dailymotion ‘Sell’ to or “Share” with third parties? And why?
As we mentioned above, we don’t provide your PI to third parties directly in exchange for money – we are not what you would traditionally call a data broker.
Disclosure of your PI to third parties is done to ensure that the content or ads you are shown on Dailymotion are potentially of interest to you and to provide reporting to content right holders and advertisers. Ex., we communicate data such as your Service ID (i.e. a digital ID number we assign to your device/browser combination), your partial IP address, information detected about the device you use to access our Service and, if we have it, our guess about your profile (e.g. age range, interests, etc. deduced based on your previous browsing history), so that those buying our advertising space can show their ads to people they think would be most interested in seeing them. These third parties may also have some information about you (ex. obtained when you visited websites and services other than ours) and use it in combination with the PI we share with them to show you targeted ads.
It is very important to know that we never disclose any information that might directly identify you (e.g. your name, your email address, your home address) to third parties and in most cases we don’t even have this information, since, unlike some other online services or social networks, we do not ask you to open an account with us in order to access our Service (unless you wish to use some of its advanced features). In addition, note that we never collect particularly sensitive data such as your credit card information or your social security number.
What kind of Personal Information might be used for “Targeted Advertising”?
Targeted Advertising consists of displaying ads selected based on personal information obtained from your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests. It means that in addition to the information on your use of our Service, information about your use of other services is being used to tailor ads shown when you watch videos on Dailymotion. Dailymotion does not track your activities outside the Dailymotion Service. Any ads considered by the US privacy state laws as “Targeted Advertising” that you may see on our Service use the data held by advertisers (ex. data collected when you interacted with their ads shown to you on other websites) or by the ad tech companies (ex. when their cookies set on your browser allow them to recognize you and observe your navigation on different websites). As we do not control that information we cannot provide a detailed list of its categories. In general, IP used for Targeted Advertising may include your age, gender, geographic location, centers of interest, device used or shopping habits.
What happens if I opt out of the Sale and Share of my Personal Information and its processing for the purpose of Targeted Advertising?
If you choose to opt out of the Sale and Share of your PI by Dailymotion and its processing for Targeted Advertising, we will stop Selling and Sharing your PI and will communicate your decision to our advertising partners. Note that, in conformity with the USA state privacy state laws, we will continue to collect and use your PI to the extent needed to carry out our own business activities (e.g. to conduct fraud detection, to adapt our Service to what we believe you expect it to be, to check if there are territorial restrictions that apply to the content you attempt to view, etc.). We will also continue to communicate your PI to companies or contractors that are our service providers. However, these service providers can no longer use your PI for their own business purposes nor allow anyone else to do so by Selling or Sharing it. In other words, the third parties to whom we disclose your PI will only use it to help us operate our business or if otherwise authorized to do so by the applicable state laws.
Note that normally ads are tailored using both PI collected by Dailymotion and PI collected by advertisers, agencies and ad tech companies. Dailymotion only collects your PI when you visit our Service. Advertisers and other third parties collect your PI when you visit multiple services and, consequently, may have a more detailed knowledge of your interests. When you Opt-Out, you will still see ads on our Service. We will continue to collect and use your PI to tailor these ads. However, your Opt-Out will likely result in a less precise ad targeting because it informs advertisers and ad tech companies that they can no longer use your PI that they collect to target ads shown on our Service.

What if I’m a minor?
As a rule, applicable laws require obtaining parental consent for processing of personal information (“PI”) of a minor under 13 years of age. For minors between 13 and 16 years of age, their explicit consent may be needed for Sale, Share of their PI and its processing for Targeted Ads. Note that if we believe you to be less than 16 years old, we automatically consider that you have opted out of Sale, Share of your PI and its processing for Targeted Ads.
